Form DS-117, Application to Determine Returning Resident Status

Form DS-117

Form DS-117 is an application for Special Immigrant Status for lawfully admitted permanent residents who are returning from a temporary visit abroad. The following evidence must be submitted with Form DS-117 in order to qualify:

1. The applicant has the status of an alien lawfully admitted for permanent residence at the time of departure from the United States;

2. The applicant departed from the Untied States with the intention or returning and has not abandoned the intention of returning;

3. The applicant is returning to the United States from a temporary visit abroad and, if the stay abroad was protracted, the reasons for the delay in returning to the United States was outside of the control of the applicant and are for reasons for which the applicant is not responsible.

Form DS-117 applicants must submit evidence with the Form DS-117 application along with proof of permanent residence status in the United States.

Form DS-117 also requires biographical information about the applicant including marital status, names and addresses of close family members in the United States and previous immigration record. The DS-117 must indicate his or her date of last departure from the United States as well as all periods the applicant has lived outside of the United States for periods of six months or longer. The form must my signed and with attestation of veracity by the Form DS-117 applicant.
