Treaty Investor Visa Overview
The E-2 Treaty Investor Visa Application Guide includes E-2 Visa general
information, Treaty Investor eligibility requirements, and additional
information about quota restrictions and for spouses.
- An E-2 Treaty Investor Visa may be obtained by individuals who wish to invest in the United States.
- A requirement of receiving the E-2 Visa is that the applicant is a national of a country with which the United States maintains a treaty of commerce.
- The individual's purpose of entry must be to carry out substantial trade of services or technology, principally between the treaty country and the U.S; or, to direct develop the operations of an enterprise in which the individual is in the process of investing a substantial amount of capital or has invested in.
- The Treaty Investor applicant must by law come to the U.S. to develop and manage the enterprise investment operation or one that is actively in the process of investing a substantial amount of capital. In addition the applicant must have ownership in more than 50% of the investment, unless the coming as an employee of the enterprise.
- There are no quota restrictions for E-2 Visas.
- E-2 Visa holders’ spouses are also eligible to accept employment in the U.S.
- E-2 Visa holders are usually admitted for a 2 year period of time (and extensions can easily be obtained)
