Form I-929, Petition for Qualifying Family Member of a U-1 Non-immigrant
Form I-929 is to request immigration benefits on behalf of a family member who never held a U non-immigrant status. A person may file Form I-929 on behalf of a family member who never held a U non-immigrant status who can show that:
1. He or she became a lawful permanent resident or have a pending Form I-485 base on his or her status as U-1 non-immigrant (victim of criminal activity);
2. His or her alien relative is eligible for immigrant classification based on the familial relationship to the applicant;
3. He or she will suffer extreme hardship if not allowed to remain in or to enter the United States; and
4. He or she can establish that discretion should be exercised in favor of the eligible family member.
If the applicant is under 21 years of age, he or she may file Form I-929 on behalf of his or her spouse, unmarried children under 21 years of age, and parents. If the applicant is 21 years of age or older, he or she may file Form I-929 on behalf of his or her spouse, and unmarried children under 21 years of age. Supporting documents evidencing lawful permanent residence status or evidence that the applicant has a Form I-485 pending based on status of U-1 non-immigrant must be submitted with the Form I-929 petition.
