Form I-526 Immigrant Petition by Alien Entrepreneur

Form I-526

Form I-526 is used by foreign entrepreneurs who want to migrate to the United States.

The applicant must provide biographical information in Part 1 of Form I-526. If the immigrant is in the United States at the time of filing Form I-526, he or she must indicate their immigrant status and I-94 number.

Part 2 of Form I-526 requires the applicant to indicate the basis of the application: whether the application is based upon an investment in a commercial venture and whether the investment amount has been adjusted upward or downward.

Part 3 of Form I-526 requires the applicant to provide information about the entrepreneurial investment. The applicant must indicate whether the business is a new venture, a purchase of an existing business, or a capital investment in an existing business. Information includes the name of the enterprise, the address of the business, the telephone number of the business, identification of the business as a corporation, sole proprietorship or partnership as well as the type of business.

The applicant/investor must also provide his or her personal financial information as well as the amount of investment intended for the venture on Part 4 of Form I-526.

Form I-526 must be signed by the applicant/investor.
